Welcome to Sear AI. By accessing or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using Sear AI, you agree to these Terms, our Privacy Policy, and our Content Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years old to use Sear AI. By using the service, you represent that you meet this age requirement and have the authority to enter into these Terms.

3. Description of Service

Sear AI is a recipe analysis and management application that provides:

• AI-powered recipe analysis from photos or text
• Multiple recipe complexity levels based on your preferences
• Dietary restriction and preference management
• Community recipe sharing and discovery
• Personal recipe library management

4. Account Registration

To use Sear AI, you must:

• Create an account with accurate information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised access
• Accept responsibility for all activities under your account

5. Subscription and Payment

5.1 Free Trial and Subscriptions

Sear AI offers subscription plans managed through your Apple App Store or Google Play Store account. Subscription terms and pricing are displayed in the app.

5.2 Billing and Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You will be charged through your App Store or Play Store account
• Subscription management and cancellation must be done through your device's subscription settings

5.3 Refund Policy

Refunds are handled by Apple or Google according to their respective refund policies. We do not have direct control over refund processing. To request a refund:

• iOS: Contact Apple Support or request through your Apple ID account
• Android: Contact Google Play Support or request through your Google Play account

6. User Content

6.1 Your Content

You retain ownership of content you submit to Sear AI, including:

• Recipe photos you upload
• Recipes you save or create
• Community recipes you share

6.2 Content License

By sharing recipes publicly in the community library, you grant Sear AI and other users a non-exclusive, worldwide, royalty-free license to use, display, and reproduce your shared content within the app.

6.3 Content Restrictions

You agree not to upload or share content that:

• Violates intellectual property rights
• Contains harmful, offensive, or illegal material
• Includes personal information of others
• Violates our Content Policy

7. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Attempt to reverse engineer or hack the application
• Abuse or exploit the AI analysis feature (excessive requests, automated usage)
• Impersonate others or provide false information
• Spam, harass, or abuse other users
• Circumvent rate limiting or subscription requirements

8. Intellectual Property

Sear AI and its original content, features, and functionality are owned by tcapdevs and are protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our intellectual property without permission.

9. Third-Party Services

Sear AI uses third-party services including:

• OpenAI: For AI-powered recipe analysis
• Supabase: For data storage and authentication
• RevenueCat: For subscription management

Use of these services is subject to their respective terms of service. We are not responsible for third-party service disruptions.

10. Disclaimers

10.1 Service Availability

Sear AI is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of AI-generated recipe analyses
• Availability of third-party services (OpenAI, Supabase)

11. Limitation of Liability

To the maximum extent permitted by law, Sear AI and its operators shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages resulting from use of AI-generated content
• Food safety issues or health problems

12. Indemnification

You agree to indemnify and hold harmless Sear AI and tcapdevs from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the service
• Content you upload or share
• Your violation of any third-party rights

13. Termination

We may suspend or terminate your account if you:

• Violate these Terms or our policies
• Engage in fraudulent or abusive behaviour
• Request account deletion

Upon termination, your right to use Sear AI immediately ceases. We may retain certain data as required by law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting with an updated version number. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the United Kingdom. Any disputes shall be resolved in the courts of the United Kingdom.
